These Terms and Conditions ("Agreement") govern all website design, development, and related services provided by TradeAid Websites, a trading service of TradeAid ("we", "us", "our") to clients ("you", "the Client"). By engaging our services, making a payment, or signing an order form, you agree to be bound by these terms in full. Please read them carefully before proceeding.
1Services Provided
TradeAid Websites provides website design, development, copywriting, and related digital services for tradesmen and construction businesses in Ireland and the United Kingdom. Services are offered across three package tiers — Starter, Pro, and Premium — as described on our website and in any written quotation provided to you.
The exact scope of work for each project will be agreed in writing (by email, WhatsApp, or order form) prior to commencement. Any services not explicitly included in the agreed scope are considered out of scope and may be subject to additional charges.
2Delivery Times & Rush Service
Standard delivery: Our typical project delivery time is 7 working days from the date we receive all required client materials (see Section 4). This is the standard timeline included in all packages at no additional cost.
Rush / 24-hour delivery: We offer an expedited 24-hour delivery service, subject to the following conditions:
- Rush delivery is available on request only and subject to our current workload and availability at the time of booking.
- Rush delivery requires all client materials (photos, content, services list, contact details) to be submitted in full at the time of booking — no exceptions.
- Rush delivery carries a surcharge of 10–20% of the total package price, as agreed in writing before work commences.
- The 24-hour clock begins from the moment all required materials are received in full, not from the time of payment.
- Rush delivery cannot be guaranteed during Irish public holidays, bank holidays, or periods of exceptional demand. We will notify you in advance if rush delivery is unavailable on your requested date.
- TradeAid Websites reserves the right to decline rush delivery requests at its sole discretion.
Delivery timelines are estimates and not contractual guarantees. Delays caused by incomplete client materials, late feedback, or circumstances outside our control (including but not limited to third-party platform outages) do not constitute a breach of contract.
3Payment Terms
Deposit: A non-refundable deposit of 50% of the total project fee is required before work commences. This deposit secures your project slot and covers initial design and copywriting work.
Final balance: The remaining 50% is due upon your approval of the completed website, prior to the site going live. We will not publish or hand over login credentials until the final balance is received in full.
Satisfaction guarantee: We will revise your website until you are satisfied, within the scope of the agreed project (see Section 6 — Revisions). You will not be asked to pay the final balance until you have approved the site. However, the deposit is non-refundable once work has commenced.
Rush surcharge: Where a rush service has been agreed, the surcharge (10–20% of the package price) is payable in full at the time of booking, in addition to the standard deposit.
All prices are quoted in Euro (€) and are inclusive of VAT where applicable. Payment is accepted by bank transfer, Revolut, or such other methods as agreed in writing.
4Client Responsibilities & Materials
To deliver your website on time and to the highest standard, we require the following from you before work begins:
- Your business name, trade, and location
- A list of your key services (up to 6)
- Photos of your work (minimum 3, recommended 6–10; phone photos are acceptable)
- Your contact details (phone, email, WhatsApp number)
- Any existing logo or branding materials (if applicable)
- Any specific copy, testimonials, or reviews you wish to include
You are responsible for ensuring that all materials provided to us are accurate, lawful, and do not infringe the intellectual property rights of any third party. By submitting materials to us, you confirm that you have the right to use them and grant us a licence to use them in the production of your website.
Delays in providing required materials will result in a corresponding delay to your delivery timeline. TradeAid Websites accepts no liability for delays caused by incomplete or late submission of client materials.
5Ownership & Intellectual Property
Upon receipt of the final balance payment in full, full ownership of the completed website — including all design files, code, and written content created specifically for your project — transfers to you, the Client.
Until full payment is received, TradeAid Websites retains all intellectual property rights in the work produced. We reserve the right to take down any website that has not been paid for in full.
TradeAid Websites retains the right to display your completed website in our portfolio and marketing materials (including social media, case studies, and our own website) unless you explicitly request otherwise in writing.
Any third-party assets used in your website (stock photography, icon libraries, fonts) are subject to their own licences. We use only legally licensed assets in all projects.
6Revisions & Amendments
All packages include one round of revisions following delivery of the initial draft. A "round of revisions" means one consolidated set of feedback submitted in a single message or document. Multiple separate revision requests will be treated as additional rounds.
Additional revision rounds beyond the included allowance are available at a rate of €75 per round, payable before work commences on the additional revisions.
Revisions are limited to adjustments within the agreed scope of work. Requests to significantly change the design direction, add new sections, or alter the fundamental structure of the site after delivery may be treated as a new project or quoted separately.
7Hosting, Maintenance & Ongoing Services
Website hosting is not included in the standard package price unless explicitly stated in your quotation. Upon completion, you have two options:
- TradeAid Hosting Retainer: We host and maintain your site on our platform for a monthly fee (typically €15–€20/month, as agreed in writing). This includes uptime monitoring, basic maintenance, and technical support. The retainer is billed monthly and can be cancelled with 30 days' written notice.
- Full Code Handover: We export your complete website code and hand it over to you for hosting on a platform of your choice (e.g., Netlify, cPanel, Vercel). A one-off migration fee may apply. Once handed over, TradeAid Websites has no further responsibility for the site's uptime or maintenance.
TradeAid Websites accepts no liability for website downtime, data loss, or security breaches occurring after the site has been handed over to the client or transferred to third-party hosting.
8Geographic Exclusivity
Where a geographic exclusivity arrangement has been agreed in writing, TradeAid Websites will not build a website for a direct competitor in the same trade within the agreed exclusivity zone for the duration of the client's active hosting retainer or for a period of 12 months from the site's launch date, whichever is longer.
Exclusivity zones are defined at the time of booking and are based on town, area, or county as agreed. Exclusivity applies to the specific trade only (e.g., "electrician in Kilkenny City") and does not prevent us from building sites for other trades in the same area.
Geographic exclusivity is a courtesy arrangement and does not form a legally binding exclusive agency agreement. TradeAid Websites will make all reasonable efforts to honour exclusivity commitments but accepts no liability for any loss arising from an inadvertent breach.
9Cancellations & Refunds
The 50% deposit is non-refundable once work has commenced. Work is deemed to have commenced upon receipt of your deposit and client materials.
If you wish to cancel a project before work has commenced, you may request a full refund of your deposit within 24 hours of payment. Cancellation requests must be made in writing (by email or WhatsApp).
If TradeAid Websites is unable to deliver your project due to circumstances on our side, you will receive a full refund of all amounts paid.
10Limitation of Liability
TradeAid Websites provides websites as a design and development service. We make no guarantee that your website will generate a specific number of leads, enquiries, or sales. Results depend on many factors outside our control, including your local market, competition, and the quality of your own service.
Our total liability to you in connection with any project shall not exceed the total fees paid by you for that project. We accept no liability for indirect, consequential, or economic loss.
11Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Ireland. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts.
12Changes to These Terms
TradeAid Websites reserves the right to update these Terms and Conditions at any time. The version in effect at the time your project is booked will apply to your project. We will notify active clients of any material changes.
